".FINDINGS,DELIBERATIONS AND DETERMINATION So hold Town Clerk MEETING OF JANUARY 17,2019 ZBA FILE #7233 NAME OF APPLICANT: Ann Aguanno and Gerald Gleason PROPERTY LOCATION: 2085 Bay Avenue, East Marion, SCTM#1000-31-17-3 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated September 14, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 18, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is recommended that the proposed action is CONSISTENT with the LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 4,943 square foot waterfront lot located in an R-40 Zoning District. The northerly property line measures 73.86 feet and the easterly property line is adjacent to Marion Lake and fresh water wetlands and measures 65.85 feet, the southerly line measures 97.77 feet and the westerly property line is 60.00 feet and is adjacent to Bay Avenue. Currently, there is a single-story dwelling with an attached wood deck facing Marion Lake. There is a 15.7 foot by 3.3 foot storage bin (shed) previously approved by this Board (Case No. 6604) and cannot be replaced as written in the decision, and an outdoor shower, both of which are attached to the dwelling on on the southerly portion of the property as shown on the survey map prepared by Nathan Taft Corwin III, L.S., last revised on August 10, 2018. BASIS OF APPLICATION: Request for Variance from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's August 17, 2018, Notice of Disapproval base on an application for a building permit to construct an accessory shed; at; 1) located in other than the code required rear yard; 2)more than the code permitted maximum lot coverage of 20%; at: 2085 Bay Avenue, (Adj. to Marion Lake), East Marion, NY, SCTM#1000-31-17-3. Page 2, January 17,2019 #7233,Aguanno-Gleason SCTM No. 1000-31-17-3 RELIEF REQUESTED: The applicant requests a variance to construct an accessory shed. The proposed accessory shed is not permitted pursuant to Article III, Section 280-15, which states accessory building and structures shall be located in the rear yard. The proposed shed will be located in the side yard. In addition, the shed is not permitted pursuant to Article XXIII Section 280-124, non-conforming lots, which states lots measuring less than 20,000 square feet in total size requires maximum lot coverage of 20%. The survey shows lot coverage at 21.7%. ADDITIONAL INFORMATION: According to the applicant's representative, the New York State Department of Conservation has issued a permit dated July 20, 2018 and a permit from the Town's Board of Trustees is pending approval. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed location of the shed in the side yard rather than the rear yard will help avoid environmental impacts to the wetlands. To mitigate the shed's potential visual impact on the street and the adjacent property to the north, the shed will be sided, painted, and roofed to match the existing dwelling; will not exceed 9 feet in height at its peak to match the height of the neighboring sheds; and will meet the required 3 foot side yard setback from the northerly property line. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject parcel has a total area of 4,943 square feet but only 4,631 square feet of buildable land area due to wetlands. Permissible lot coverage is limited to 926 square feet, which is little more than the minimum 850 square feet of livable floor area required for a single-family dwelling in an R-40 Zoning District. The current lot coverage is 911 square feet and the addition of the proposed 96 square foot shed on the property will require 81 square feet of lot coverage relief. 3. Town Law &267-b(3)(b)(3). The variance granted herein is not mathematically substantial for the requested lot coverage relief, representing 8.5% relief from the code, but is substantial at 100% relief from the code for the proposed non-conforming side yard location. However, the existing small dwelling has no basement or storage area, accessory sheds are common in the neighborhood, the shed will have a conforming side yard setback, and it will be located at least 39 feet from the wetlands to protect the freshwater wetlands and surface water of Marion Lake. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Placement of the shed in the side yard instead of the rear yard avoids impacts to freshwater wetlands associated with Marion Lake. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The New York State DEC has issued a permit approving the installation of an 8 foot by 12 foot shed. The application also requires approval by the Town of Southold Trustees.. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora , seconded by Member Planamento, and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin, III revised August 10, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. However, since the shed does not require a Building Permit, I assume they would not apply for a C/0, and there would be no permit for a C/0 to confirm compliance with regardless. Would the Wetlands Certificate of Compliance they'll need to obtain be considered an acceptable substitute? As I'm not sure how to ultimately close the loop here, please give me some guidance when you can. Specifically, many of the properties located in close proximity to the subject parcel are less than a quarter-acre in size with even smaller "Buildable Land" areas due to the presence of freshwater wetlands associated with the lake, leaving both limited space indoors and outside on the property for storage of common recreational and household items such as outdoor lawn furniture, bicycles, kayas, and gardening equipment. The subject parcel, for example, has a total area of 4,943 sf and a buildable land area of 4,631 sf, meaning that permissible lot coverage is limited to 926 square feet, little more than the minimum 850 sf living floor area required for a single-family dwelling in an R-40 zoning district. Because current lot coverage is 911 square feet, addition of the proposed 96 sf shed on the property will require 81 sf of lot coverage relief from §280-124(B) since total lot coverage will increase to 1,007 square feet or 21.7 percent of buildable land. However, granting of this relief will not produce an undesirable change to the character of the neighborhood. Rather, the overall lot coverage and structural density of the property will be consistent with that of the surrounding community and the two neighboring properties in particular, both of which are similar in lot size and improved with similarly sized dwellings and sheds located in close proximity to the applicants' side property lines. And to additionally mitigate the shed's potential visual impact on the neighborhood and the northerly adjacent property in particular due to the additional relief needed from §280-15 for placement of the shed in the northerly side yard, the shed will be sided, painted, and roofed to match the existing dwelling; will not exceed 9 feet in height at its peak to match the height of the neighboring sheds; will meet the required 3' side yard setback from the northerly property line; will be largely obscured from the view from the north by the existing 6' stockade fence located along the property line; and, unlike the neighboring sheds, would not interfere with lateral water views. Therefore, granting the relief needed from §280-15 and §280-124(B) to erect the proposed shed will not have an undesirable impact on the character of the neighborhood or cause a detriment to nearby properties. And the benefit of having additional storage space on the property cannot be more reasonably achieved by any means other than proposing a detached storage shed on the property. Specifically, the very small house, which contains no garage, no basement, no attic, and has a total footprint of 665 square feet (including the porch and stoop), simply does not provide sufficient space for storing common household or recreational items such as outdoor patio furniture, bikes, kayaks, bar-b-que grill, or lawn mower. And although a small outdoor"shed"that was authorized by the Board for the prior owners in 2012 remains currently "attached" to the house, this structure is truly a small, narrow storage bin for small items; is not watertight; and pursuant to the Board's decision can never be replaced (Case No. 6604). Therefore, the need for additional storage space and the requested area variance relief is unavoidable. 3) The 81 sf of lot coverage relief required for the proposed shed, which is small enough to be exempt from Building Permit requirements, is mathematically insubstantial. The relief required for placement of the shed in a side yard is also insubstantial, as the shed meets the required side yard setback and would not affect the neighboring properties any differently than if it were located in a conforming rear yard location to the east of the house. 4) Placement of the proposed 96 sf shed would not have any significant adverse impacts on the physical and environmental conditions of the subject property or natural resources. In fact, the shed is proposed in the side yard rather than in the rear yard—where it would be located substantially closer to the freshwater wetlands associated with Marion Lake—in in order to avoid any such natural resource impacts.
