McLeod and Chun Y Cheung PROPERTY LOCATION: 605 Sound View Avenue,Mattituck,NY SCTM No. 1000-94-1-4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 21, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 18, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRR Furthermore, the LWRP coordinator recommends the landowner replace the existing sanitary system with a UA OWTS sanitary system. and that a vegetated non-turf buffer be installed along the bluff with planted vegetation native to the area. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred for an evaluation and recommendation to the Suffolk County SWCD. According to the information provided in a letter from the agency dated December 21, 2018, following an inspection conducted on October 26, 2018 with a follow- up visit on November 29, 2018, the agency described the yard as well vegetated in turf grasses and generally flat. Natural slope of the yard does not pose issues for construction in current vegetated state. It was suggested that permeable or semi- permeable pavers for patio be used. Signs of minor erosion were cited on the east side of the bluff top, and the agency suggested that a sprinkler which may have caused the erosion, should be removed. The agency commented that the design shows adequate drainage structures for pool, spa and shower. Furthermore, it is Page 2,January 17,2019 #7230,McLeod SCTM No. 1000-94-1-4 recommended that no heavy machinery be driven and stored within 25 feet of the bluff top as extreme weight and vibrations of such,equipment may cause instability. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,769 square foot waterfront parcel located in an R-40 Zoning District. The parcel has 25,800 square feet of buildable lot coverage. The parcel has 100.72 of bluff frontage along the Long Island Sound. The parcel runs 110 feet along Sound View Ave, 393.97 feet on the West side and 383.50 feet on the East side. The parcel is improved with an existing two story frame house and garage under, a pool, a shed, and a garage under construction. ,All is shown on a survey prepared by John Metzger,LLS, dated June 19,2018. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1) and the Building Inspector's August 13, 2018,Notice of Disapproval based on an application for a building permit to make additions and alterations to an existing single family dwelling; at; 1) located less than the code required 100 feet from the top of the bluff, at: 605 Sound View Avenue, (Adj. to Long Island Sound),Mattituck,NY. SCTM#1000-94-1-4. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to the first and second floor of an existing single family dwelling with a non-conforming bluff setback of 51.8 feet where code requires a 100 foot bluff setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3, 2018at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family waterfront homes. The proposed additions and"alterations are.on the North side of the property and away from the public road. There is an accessory garage in the front yard of the property which blocks the view of the proposed additions and alterations from the street. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling was built in 1963 prior to the current zoning regulations. The existing residence has a non-conforming bluff setback and any addition to the existing residence on the seaward side would require the benefit of an area variance. 3. -Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 49%relief from the code. However, the existing residence is 55.8 feet from the bluff and the additional variance relief is requested to accommodate a small second floor balcony. The applicant stated that the proposed balcony will be cantilevered into the framing of the house; and therefore, will not need any additional excavation or concrete footings disturbing the bluff. 4. Town Law U67-b(3Nb)(4). No evidence has;been submitted to suggest that a variance in this residential community will have an adverse impact on the 'physical or environmental conditions in the neighborhood. However, the LWRP coordinator recommends that the existing sanitary system be upgraded to an I/A OWTS sanitary system, and that a vegetated non-turf buffer,be installed along the bluff with planted vegetation native to the area. In addition,the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,January 17,2019 #7230,McLeod SCTM No. 1000-94-1-4 5. Town Law V67-W)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a second floor terrace and sunroom addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the Site Plan, dated August 16, 2018, Elevation Plans, dated August 14, 2018 (pages 1 & 2) and July 18, 2018, and Architectural Floor Plan Plans, dated July 18, 2018, all prepared by Mark Schwartz, Architect. SUBJECT TO THE FOLLOWING CONDITIONS:- 1. The applicant shall replace the existing sanitary system with an UA OWTS sanitary system as approved by the Suffolk County Department of Health. 2. The applicant shall install and maintain a 10 foot wide non-turf buffer along the top of the bluff and remove or re-direct any in-ground sprinkler heads that are directed toward the bluff. 3. This approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The property Site Plan has been prepared by the office of Mark Schwartz &Associates last dated 8/16/18. Please consider the following: 1. This project includes several additions & alterations that include various new patios surrounding an existing swimming pool and a new pool house While it appears that there may be some existing site drainage it is not clear as to whether or not this existing drainage meets the requirements of Chapter 236 for Storm water Management. Due to the size and scope of the proposed additions & alterations it is recommended that new drainage calculations be provided to include all impervious surfaces over the entire site. 2. All existing drainage should be certified as to its size and location. New drainage calculations and a new site drainage design meeting the requirements of Chapter 236 should be provided. 3. The existing gravel driveway surface should be included in the calculations using a runoff coefficient of 1.0. Drainage for the driveway should also be installed at the property line adjacent to Sound View Avenue to contain all stormwater. 4. Drainage calculations are currently indicated at more than one location on the drawing. These revised calculations should be provided in one location to prevent misperception or mistakenness with regard to code requirements. 5 The drainage for the outdoor shower must either be noted or details should be provided to indicate how the excess water will be contained. Dimensions are shown between the Top of Bluff and various surfaces along the northerly side of the residence. The 68' dimension appears to be inaccurate when you look at all the other dimensions noted. This dimension should be verified. 7. In general, the top of bluff slopes gradually toward the front-southerly portion of the site. For this reason any ground disturbance along the northerly portion of the existing residence should not generate erosion issues. However, it is suggested that all work and/or ground disturbance along the Top of Bluff maintain a minimum setback of 25'. SCTM #1000-94-1-4 Dear Chairperson Weisman, Observations: In response to your request a site visit was conducted on October 26, 2018 with a follow up visit on November 29, 2018 to review and evaluate a proposal to develop a parcel located at.605 Sound View Avenue in Mattituck.The property is located on a bluff along the Long Island Sound in a residential area. This site is the location for the alterations and additions to an existing dwelling. We could not access the front yard during the initial visit due to a locked gate, similarly we could not access the lower portion of the bluff face or inspect the bulkhead at the toe of the bluff because a another locked gate. When the initial visit was conducted ground disturbing construction had not commenced, however,upon the follow up visit to this site construction had begun in the front yard. The yard was well vegetated in turf grasses and generally flat. The natural slope of the yard does not pose issues for construction in the current vegetated state. It is recommended when increasing the footprint of the patio, runoff be considered. Permeable or semi-permeable pavers and concrete are strongly suggested. The portion of the bluff we were able to inspect was well vegetated in stabile condition. An existing retaining wall positioned roughly half way up from the toe appears to be in fair condition. On the east side of the bluff top there are sign of minor gully erosion and lacking vegetation. This erosion may be caused by a 360 degree sprinkler located in the garden directly atop the bluff in line with the erosion. This sprinkler should be removed or changed to a 180 degree emitter as to not discharge any water onto the bluff. We did not notice any other irrigation on the parcel contributing waterto the bluff. The proposed design for the alterations to the dwelling seem to have made adequate provisions for capturing stormwater. 100% of rooftop runoff should be collected in drywells and not discharged onto the ground. Officc Hours:Monday through Thursday 7:30 a.m.to 4:00 p.m. Friday 7:30 a.m.through 3:00 p.m. During the follow up visit, major excavation was taking place in the front yard, south east portion of the property. This area slopes away from the bluff and this construction poses no major threat to the bluff. At the time of the visit, there were provisions made for erosion and sediment control. The design shows adequate drainage structures for the pool, spa, and shower. Finally, it is not recommended that machinery be driven or stored within 25' landward of the bluff top, and use of the rear yard landward beyond 25' be limited for moving and storing machinery as extreme weight and vibrations of such equipment may cause instability. In addition,you describe a trellis overhang over the garage door to,be replaced with a roof overhang of the same dimensions. I have reviewed your letter and the Zoning Board of Appeals determinations No.7087, as well as the architectural plans prepared by Mark Schwartz, dated January 30, 2019. The additions described and depicted on your plans are located seaward, or within the 100 ft. setback from Top of the Bluff. Based upon the information provided, I have determined that the requested construction of two pergolas over decks and roof overhang to be located less than the minimum 100 feet setback from the top of the bluff is not de minimus in nature because not only does your request potentially increase the degree of nonconformity on the subject lot,but the prior ZBA public hearing and decision made no mention of any proposed pergola or roof overhang construction. Therefore,your client will be required to return to the Building Department and accurately detail the distance of the proposed construction from the top of the bluff in order to obtain a new Notice of Disapproval, and then apply to the ZBA with a current survey or site plan prepared by a design professional for additional variance relief.
