SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 18, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP Coordinator made the following recommendations in order to mitigate inconsistencies with LWRP policy standards: In compliance with ZBA relief granted in 2014, #6711, the applicant is required to install a 20 ft. wide perpetual, landscaped buffer landward of the tidal wetland. The applicant should verify that the buffer is in place, and if not, that it be constructed. The owner shall replace the existing sanitary system with an I/A On-site Wastewater Treatment System due to the proximity to Deep Hole Creek. With the conditions imposed herein, the Board of Appeals finds that the action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is located in an R-40 Zoning District, and is a non- conforming 22,570 SF waterfront parcel. The parcel is improved with an existing two-story dwelling with an attached porch and patio, an accessory swimming pool, and an accessory garage. The parcel has a frontage on Lupton Point Road of 208.48 ft. along the westerly property line, then running north for 110.79 ft. to Deep Hole Creek, then running 44.78 ft. along the creek to the easterly property line, then running 198.24 ft. to Lupton Point Road as shown on survey by John Metzger,Land Surveyor, last revised November 21, 2013. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's July 24, 2018,Notice of Disapproval based on an application for a building permit to legalize"as built" Page 2, January 17, 2019 #7227, Doka SCTM No. 1000-115-11-4.1 addition and alterations to an existing single family dwelling and legalize "as built" accessory apartment in an accessory garage; at; 1) less than the code required minimum rear yard setback of 50; at: 755 Lupton Point Road, (Adj. to Deep Hole Creek), Mattituck,NY. SCTM#1000-115-11-4.1. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built"basement addition, described as a basement extension/ with covered porch above at the first floor, and open deck with railing at the second floor level with a setback of 42.8 feet at the closest point, where a minimum setback of 50 feet is required. ADDITIONAL INFORMATION: At the public hearing,the applicant's architect gave testimony that there is currently a Southold Trustees application pending but had no knowledge of any New York State Department of Environmental Conservation(NYSDEC) application in process. The applicant's agent was asked to provide information on the condition and location of the existing septic system and its location. It was stated that the current system is in the front yard, and the applicant agreed to update the sanitary system per the recommendation of the LMW coordinator. The agent was also questioned about the chain of events that led to the"as-built" condition of the application. As per testimony from the owner, it was stated that they didn't know about the need for a building permit when constructing the basement addition, since it was located under an existing first floor deck that had received prior setback variance relief. On January 23, 2014, (46711) a prior owner was granted relief for alterations and additions for a proposed rear deck having less than the required bulkhead setback(63.4 feet where the code requires a minimum of 75 feet), subject to the conditions that; 1)the deck remaining open to the sky; 2)that the construction and maintenance of a perpetual 20 feet wide landscaped buffer be installed landward of the tidal wetland line, as shown on survey prepared by John T. Metzger, LLS, last revised November 21, 2013. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law t 267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Lupton Point area consists of approximately 22 described lots which predate zoning, located on a quiet, private street. The subject property has been in existence since prior to zoning with no evidence of adverse impacts. The proposed additions are on the rear(seaward side) of the house and will have no visual impact on the street. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The present home has been in existence since prior to zoning and is located within the 75 foot bulkhead setback and the 50 foot rear yard setback. The proposed "as- built" walkout basement extension with enclosed porch and open deck above were built under the existing first floor deck (elevated on the seaward side due to the slop of the property) which was previously granted setback relief of 63.4 feet from the bulkhead where the code requires a minimum of 75 feet. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 15% relief from the code for a rear yard setback of 42.8 feet at the closest point where the code requires a minimum of 50 feet. However, the lot is irregularly shaped and the house is cited at an angle to the rear property line so that the setback increases to 63.4 feet from the portion of the rear of the lot that is bulkheaded which was the subject of a prior variance approval. The"as-built"basement addition is maintaining the same setbacks that currently exist. Page 3, January 17, 2019 #7227, Doka SCTM No. 1000-115-11-4.1 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and comply with the determination made by the LWRP coordinator, and the conditions set by this board. 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an "as-built" basement addition enclosed porch and open deck above while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dames, and duly carried,to GRANT the variance as applied for, and shown on the plans (site plan, elevations, floor plans) prepared by Angela Mangels, Architect, dated July 25, 2018, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install an alternative waste water treatment system as approved by the Suffolk County Department of health. 2. Provide a 20 ft. wide perpetual landscaped buffer landward of the tidal wetland line as per previously conditioned in ZBA decision # 6711 and noted in December 18, 2018 memorandum by the Southold LWRP. 3. The Applicant shall submit an amended survey prepared by a licensed surveyor depicting the installation of a 20 ft.wide perpetual,landscaped buffer landward of the tidal wetland line in accordance with ZBA decision #6711 of 2014,and to the satisfaction of this Board. 4. The existing second floor deck to remain "open to above" as per prior variance #6711, dated January 23,2014. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. If the Building Department determines that the construction of additions and alterations, as described in this determination, exceed the scope of the approvals granted herein, or a demolition has occurred, the Zoning Board of Appeals shall retain jurisdiction and shall have the right, after a public hearing, to modify, suspend or Page 4, January 17, 2019 #7227, Doka SCTM No. 1000-115-11-4.1 revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXU Section 280-141 of the Town Code. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The present home has been in existence prior to zoning and is located within the 75 foot bulkhead setback. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 15% relief from the code. However, the proposed second floor deck is proposed above an existing deck and will maintain the same setback that presently exists. 4. Town Law 4267-b(3)(b){4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and shall comply with the determination made by the LWRP Coordinator, 5, Town Law 4267-b(3)(b)(5). The difficulty has been self-created.
