SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 24, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is is a conforming 96,366 square foot parcel located in an R-80 Zoning District. The parcel is irregularly shaped and runs 152.43 feet along Main Road (NYS Route 25), runs 588.24 feet on the East side, 131.42 feet on the North side, 488.52 feet on the West side before turning 81.17 feet North west and then turning South and running 132 feet on the West side. The parcel is improved with a 2 story frame masonry dwelling, a masonry garage, and a frame barn. All is shown on a survey by Harold F.Tranchon,LLS dated September 22,2016. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280-13B, Subsection 14 of the Zoning Code, to legalize an as-built Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their principal residential occupancy under the Building Department's Certificate of Occupancy Z7392 dated November 29, 1976. The proposed one- bedroom for lodging and serving of breakfast to two B &B casual, transient roomers was created by using an existing bedroom, bathroom, and outside entrance in the existing building. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 3, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements I Page 2,January 17,2019 #7222SE,Maida SCTM No. 1000-102-2-13 set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Alexis Eileen Norris Maida and Marco Maida , the applicants herein, are the owners of the property. It is improved with a two (2) story frame and masonry dwelling, masonry garage and frame barn as shown on the survey by Harald F Tranchon, Jr., LLS, dated September 22, 2016. The owners/applicants will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. 2. The applicants have submitted the following proof that the subject premises is their principal dwelling: NYS tax return, utility bills, driver's license, and voter registration. 3. The applicants plans comply with the on-site parking requirements and provide for 5 parking spaces, four for the principal single-family use and one(1)for the Accessory Bed and Breakfast bedroom) 4. The applicants complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 5. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 6. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 7. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 8. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 9. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 10. No adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Southold Town Zoning Code. 11. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. 12. The proposed B & B is located is located within walking distance of the Cutchogue Hamlet business center and shopping districts. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Dantes, seconded by Member Planamento and duly carried to GRANT the Special Exception permit for an Accessory Bed and Breakfast for a one (1) guest bedroom to be used only in conjunction with the applicants-owners residence, as applied for and shown on the two page floor plan by Hadley Wiggins (undated), received August 3, 2018, and survey by Harold F. Tranchon, Jr., LLS, dated September 22,2016 SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. The applicant's shall install a small sign indicating that there shall be no backing out of the driveway on to NYS Route 25,Main Road. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings, cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The applicant alleges that the approval of this exception would be in harmony with the intent and purpose of said zoning ordinance and that the proposed use conforms to the standards prescribed therefore in said ordinance and would not be detrimental to property or persons in the neighborhood for the following reasons: The B&B use is for one bedrooms. The house is pre-existing and was constructed with an annexed "dentist office"which is currently an additional bedroom. The house is located on Main Road, adjacent to the Christmas Tree Farm which generates tourism in the community. The location provides convenient lodging for guests arriving by Hampton Jitney. The Maida's have one child and another child on the way. The house is very large and the proposed B&B room is not utilized. Attached plans: 1. A fire safety notice shall be affixed to the occupied side of the entrance door of each bedroom for B&B use indicating; 1) means of egress, 2) location of means for transmitting fire alarms, if any; and 3) evacuation procedures to be followed in the event of a fire or smoke condition or upon activation of a fire or smoke-detecting or other alarm device. YES, the bedroom has direct access to the outside. 4.No sleeping rooms for B&B use shall be located above the second story. YES, the B&B is proposed for the separate wing(formerly the dentist office). 5. The dwelling shall have at least two (2) exits and there shall be a window to code to provide emergency egress in every sleeping room for B&B use. Yes Means of egress shall include at least one of the following alternatives: 1) A portable escape ladder that attached securely to the sill, shall be provided for second story rooms for B&B use, constructed with rigid rungs designed to stand off from the building wall, it shall be capable of sustaining a minimum load of 1,000 pounds, and shall extend to and provide unobstructed egress to open space at grade, 2) an exterior stair per code, 3) or limited area sprinkler system per code. None of above egress requirements is applicable because the room has access directly to the outside . 6. There shall be no exterior signage identifying the,use as a Bed and Breakfast in residential areas. The location of the B&B is on the Main Road, in close proximity to commercial uses, a small sign would be appropriate at this property. 7.No accessory apartment, as authorized by Section 280-13(B)(14), shall be permitted in or on premises for which a Bed and Breakfast is authorized or exists. The house is a single family dwelling with no accessory apartment. 8. This conversion shall be subject to a building permit, inspection by the Building Inspector and Renewal of Certificate of Compliance annually. OK 9.
