SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is 28,705 square foot conforming lot located in a R-40 Zoning District. The northerly property measures 200.76 feet, the easterly property measures 150.12 feet, the southerly property measures 200.00 feet and the westerly property adjacent to South Harbor Road measuresl37.10 feet as shown on the survey map by John C. Ehlers, LS and dated September 19, 2017. Currently there is a single-family two-story residence with an attic above the second floor, and a one story detached accessory garage located in the rear side yard. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280-13B, subsection 14 of the Zoning Code, to operate a Bed and Breakfast with four (4) guest bedrooms for lodging and serving of breakfast to eight(8) B &B casual, transient roomers accessory and incidental to their principal residential occupancy within their existing single-family dwelling, under the Building Department's Certificate of Occupancy No. Z4627, dated May 3, 1972. A Building Permit 442438, dated March 6, 2018 was issued for proposed alterations and additions to the residence by the Southold Town Building Department. ADDITIONAL INFORMATION: The single-family residence was originally built in 1897 and was known to be a boarding house. The applicants were issued a Building Permit to make additions and alterations to this old historic home to bring it up to date while preserving the historic charm. The home has five (5) bedrooms as one will be occupied by the applicants. (owners). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 3, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Alejandro Azcona and Daniel DeVito, the applicants herein, are the sole owners of the property, located at 565 South Harbor Road, Southold, NY which is a two-story five (5) bedroom and five and a half(5.5) bathroom residence with a third-floor attic with a detached garage as shown on the survey by John C. Ehlers, LS dated 09-19-2017. The owners/applicants will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. The applicant(s) has/have submitted the following proof that the subject premises is their principal dwelling: voter registration forms, driver license, utility bill and deed. 2. The applicants plans comply with the on-site parking requirements and provide for six(6) parking spaces, two for the principal single-family use and one (1) for each of the Accessory Bed and Breakfast bedroom(s) 3. The applicants complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 5. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 6. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 9. No adverse conditions were found after considering items listed under Section 280-142 and 280- 143 of the Southold Town Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Weisman(Chairperson), seconded by Member Planamento, and duly carried to GRANT the Special Exception permit for an Accessory Bed and Breakfast for four (4) guest bedrooms, to be used only in conjunction with the applicants-owners residence, as applied for and shown on the Site Plans dated November 2, 2018 and prepared by Anthony M. Portillo, Architect. Page 3,January 17, 2019 #7197SE, Azcona-Devito SUM No. 1000-74-4-1 SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revolve the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings, cited in this decision will result in - delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Before the Bed and Breakfast is occupied by guests, the applicant must obtain the final Certificate of Compliance for Bed and Breakfast occupancy from the Building Department. Please also be advised that this Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein.
