Regarding the landward limit of tidal wetlands as shown on the subdivision map prepared by Young& Young, last revised on January 8, 2015, the Board has determined that it appears to be,accurate. The Board.of Trustees have 1 00' of jurisdiction from.the landward edge of tidal wetlands, as.well.as.the underwater lands of Mattituck Creek. The Board of Trustees do not require permits to subdivide a property, however, if any clearing of trees/vegetation or structures (e.g, shed, fence, pool,,dwelling, dock)were to be proposed within the jurisdictional area, a permit would be required from this office. i. h Due to the shallowness of1his branch of Mattituck Creek and restrictions in Chapter:215 of the Town Code,,marine construction maybe,severely restricted,or prohibited. They all felt that a dock decision for each lot should be made on the application of the owner at the time rather than stipulating something now. It may be that at least as to the easterly and possibly the middle lot that only a kayak-access type dock might be allowed, and it is not clear what size dock could go on Lot 3, but that would be determined based on soundings and other applicable measurements at the time of a full application. We would like the Planning Board to agree as part of the subdivision approval that the applicant reserves the right to grant access easements to Lot 1 and 2 over Lot 3 for dock access. This will allow the owner to determine whether to encumber Lot 3 at the appropriate time. The Trustees thought that was a good idea, but at this point we don't know whether a dock that would be sufficient to accommodate three users is possible. So their recommendation as I understood it is that water access from the lots by dock will be determined future application and not now.
