SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 27, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject 27,386 square feet, irregular-shaped, non-conforming parcel is located in the R-40 Zoning District and measures 128 feet along Skunk Lane, then runs north 110 feet along a residential neighbor to the west,turning slightly and continuing 106.02 feet and again bending 50 feet north before turning 74.23 feet along its northern lot line also shared with a neighboring residence before running south 256.95 feet through a pond, shared by a third neighboring residence, at its southeastern corner. The subject parcel is improved with a single-family residence, built over a garage,with a raised deck on its westside, as illustrated on the site plan prepared by Mark K. Schwartz,AIA and dated February 7, 2018. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's December 4, 2017 Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single-family dwelling; at; 1) less than the code required minimum rear yard setback of 50 feet;located at: 7625 Skunk Lane, Cutchogue,NY. SCTM#1000-104-4-27.2. RELIEF REQUESTED: The applicant requests a variance to construct a raised wood deck of 180 square feet, measuring 10 feet by 18 feet, over the garage entrance 48.3 feet from the rear property line where the Code requires a rear yard setback of 50 feet. During the public hearing the members agreed the actual distance requiring relief, according to the submitted site plan, is 38.3 feet from the rear property line. ADDITIONAL INFORMATION: No member of the public spoke in favor of, or against this application. Wetlands located on the subject property represent 7,796 square feet or 28.5%of the overall lot. f Page 2,April 19,2018 #7149,'Tietjen SUM No. 1000-104-4-27.2 As aforementioned, the members agreed that the actual distance requiring relief, according to the submitted site plan, is 38.3 feet from the rear property line instead of the distance indicated on the Notice of Disapproval. The applicant's agent illustrated the history of the property highlighting ZBA file #3925 issued May 29, 1990, which granted area variances in order to achieve subdividing the subject property from the residence immediately to the west. Also, submitted with the application is a Letter of No Jurisdiction from the New York State Department of Environmental Conservation dated November 6, 2017. This document is a matter for the Town's Building Department to consider before issuing a building permit. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed addition is to be located on the front fagade of the residence which was built 10 feet off of the northern property line, it was originally built as an accessory structure to the neighboring residence prior to subdivision and has stood without incident for many years. A deck addition is also a common accessory to a residential structure in the general area and the Town of Southold overall, and will not impact other residences or those using Skunk Lane, as it is sited nearly three times the required front yard setback and the front and side yards have mature plantings screening the property from view. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Given the original structures location and the existing west side, raised deck allowing access to the residence, there is no other feasible location for the applicant to locate the proposed addition other than on the south fagade of the structure. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 11.7% relief from the code for a rear yard setback of 38.3 feet. The structure when originally built, prior to subdivision, was an accessory to the neighboring residence. The proposed deck, measuring 180 square feet, 10 feet by 18 feet, is not substantial when calculated against the permitted lot coverage. All improvements, including those proposed, measure only 5.5% of the buildable lot where the Code allows 20%. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased and subdivided the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b.
