Courtney Hoblock and Barbara Close to Joanne Bagan Premises: 530 Orchard Street, Orient Dear Amanda or Mike: My clients have asked that I resolve an open issue regarding the pre-CO for the existing garage. There is an existing living space on the 2nd floor of the existing garage. The pre-CO is silent regarding the 2nd floor living area. The Buyer's attorney is requiring us to obtain a revised pre-CO. The closing took place with an escrow to cover the cost and for the sellers (my client) to obtain the pre-CO. Enclosed is an application for a revised pre-CO which includes the existing living space/guest quarters on the 2nd floor of the garage. As Background: On 4/28/93 William Price on behalf of the owner, Robert Van Nostrand filed an application for the pre-CO (#z-22284). This application included the consent to inspect which requesting the following: Pre-existing certificate of occupancy for 1-1/2 story frame dwelling with attached porch, detached garage and sheds, and lire-existing conforming guest quarters. The pre-CO was issued by the building department in 1993 based on the application which included the guest quarters. The application did not generate a notice of disapproval for the existing guest quarters. In addition, the pre-CO does not include a violation for the guest quarters. As is the practice by the building department, a CO is issued based on the application "as applied for". To local attorneys, over the years,the pre-CO has been interpreted to include the guest quarters. As the years go by,the document should be clear and not rely on building department procedures. Moreover, the Southold Town Assessor's property card included a notation made by the assessors on 10/95, the existence of the garage w/apt"dormer second floor(Apartment) and 11t floor kitchen (10 x 23)". See attached property card. I have also attached an affidavit by Gary Tabor from Orient. He is a long-time resident of Orient and lived next door with his parents, he is familiar with the guest quarters and attests to the existence of the guest quarters built prior to zoning. Also attached is the affidavit of Matthew K. McGuire, a prior owner of the property from 2006 to 2012. The guest quarters still remains today. The owners have an open building permit for a pool, hot tub on a deck. John has made the required inspections, electrical inspections were also completed, but the permits will not be issued until the pre-existing guest quarters are recognized. I have attached a hand noted(red highlighter) survey with the applicable permits to help clarify the existing permits and open permits. This may be helpful to the building department. I make this affidavit in support of the request to amend the Certificate of Pre-Existing Use dated April 28, 1993 ( Z-22284) to expressly include the existence of the rooms above the garage which have been in existence prior to the date of the zoning code. I am 78 years old, born on March 4, 1943 and I have lived my entire life in Orient, I grew up in the house next to 530 Orchard Street. My grandparents owned all the farm land behind 539 Orchard Street. In 1957 the property was owned by Luscious and Anne House. Our families were friends, I visited their property many times prior to 1957 when I was young teenager, and throughout the time they owned the property. I specifically remember the upstairs living space of the garage prior to 1957. The living space had old pine planks and a small bathroom. I remember that the floors in the upstairs of the garage matched the old wide pine planks with the darkened nail holes in the house. The interior finishes were very old and pre-dated the 1957 zoning code. In 1965 Robert Van Nostrand purchased the property. Mr. Van Nostrand used the first floor of the garage as a workshop, and I sometimes went over there to help him. He used the first-floor area as his workshop for his Lobstering and fishing business. Mr. Van Nostrand hired me to work for him periodically in the T 1960's, and in 1973 1 helped him build the addition to the back of the garage. The third bay was constructed in the rear in 1973. The firstfloor Garage has two front bays and Mr. Van Nostrand's workshop, and on the second floor over the garage is the living area and a bathroom. The +� access to the se con oor living area is by an interior staircase. The interior staircase is original and matches the age of the garage. A second access (open staircase) from the second floor and on the east side of the garage was added later. The second floor of the garage should have been noted as such on the 1993 pre-CO issued by the Town, containing a living space a bathroom. I know that Mr. Van Nostrand's daughter lived on the second floor living area of the garage while she was in college. The upstairs of the garage was not a recent reconstruction. Gary L.
