Matthews, Attorney In The Matter of the Application : of Maarten van Hengel : For Pre-existing, Nonconforming : Certificate of Occupancy : on Premises situate : on Fishers Island, New York : STATE OF NEW YORK COUNTY OF SUFFOLK SS.: AFFIDAVIT say: I, W. GORDON AHMAN, having been duly sworn, do depose and I am over the age of 21 years and now reside on Fishers Island, Town of Southold, County of Suffolk and State of New York. I have lived on Fishers Island since 1949 and have been familiar with the buildings and properties on the island since that date. From 1967 to 1973, I was the real estate representativei of Fishers Island Farms, Inc. and in 1973 I became a licensed real estate broker with offices on Fishers Island. This is to certify that I have been familiar with the premises formerly owned by Warren F. Maynard situate on Inner Bay or Harbor, which premises were thereafter conveyed to Marcel L. Rioux and Loretta A. Rioux, his wife, and are now subject to Contract of Sale to Maarten van Hengel. Said premises are improved, and have been improved, with three structures since prior to April 23, 1957. Said buildings consist of two residential buildings, the northerlymost building being divided into two residential apartments and the third building having formerly been a Fish Market, and prior to that, a fish and lobster storage area. Since prior to 1957, the southerlymost building, which is and still is a single family residence, has been/used and occupied as a one- family residence and has been rented as such. The upper or northerly building, which consists of two one-family apartments, and still is has also been/used and occupied as a two-family residence since prior to April 23, 1957. This upper building has been used as th~ residence of the Maynard family, or, subsequently, the Rioux family. The two-family residence pre-existed zoning and since prior to zoning, has been continually rented or occupied as a two-family residence either on a year-round basis or on a summer rental basis. To my knowledge, at no point was the two-family use ever abandoned or discontinued. This Affidavit is made for the purpose of inducing the Building D~partment Southold Town {~M~X~f~xXxWf~ to issue a pre-existing Certificate of Occupancy recognizing the existence of said three structures prior to the adoption of zoning and further recognizing the fact that since prior to the adoption of the zoning ordinance by the Town of Southold, the upper residence was used and occupied as a two-family residence and the lower or southerly residence was used and occupied as a one-family residence.
